Terms and Conditions of Use

1. General information

Welcome to RaX, the 100% digital Rent-a-Car management software. These terms and conditions govern the use of our platform and services.

By accessing and using RaX, you accept these terms in full. If you do not agree with any part of these terms, you must not use our services.

2. Service description

RaX is a digital platform that provides comprehensive management tools for vehicle rental companies, including:

• Booking and contract management
• Secure payment processing
• Digital check-in and check-out
• Integration with OTAs and payment systems
• Telematics and automation tools
• API and webhooks for custom integrations

3. Pricing model and billing

3.1 Free plan

RaX offers a free plan that includes up to 20 bookings managed per month at no cost. This plan does not require subscription, commitment or contractual commitment.

3.2 Pay per use

From booking number 51, each managed booking is charged at €1.9 (VAT included). There are no fixed fees, mandatory subscriptions, commitment costs or minimum commitments.

3.3 Billing and payments

Billing is done monthly based on the number of bookings managed. Payments are processed securely through Stripe. The Customer agrees to maintain a valid payment method in their account.

3.4 Taxes

All prices include applicable VAT. The Customer is responsible for any additional taxes that may apply according to their jurisdiction.

4. Registration and user account

To use RaX, you must create an account by providing truthful and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials.

You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable use

By using RaX, you agree to:

• Use the platform only for legitimate vehicle rental management purposes
• Not perform activities that may damage, disable or overload our services
• Not attempt to access restricted areas of the platform
• Respect intellectual property rights
• Comply with all applicable laws and regulations

6. Intellectual property

RaX and all its content, including software, design, texts, graphics and functionalities, are the property of RaX and are protected by intellectual property laws.

You are granted a limited, non-exclusive and non-transferable license to use RaX in accordance with these terms.

7. Data protection

The processing of personal data is governed by our Privacy Policy, which complies with the General Data Protection Regulation (GDPR) and the Organic Law on Personal Data Protection and guarantee of digital rights (LOPDGDD).

We only process data necessary for service provision and maintain appropriate technical and organizational security measures.

8. Limitation of liability

RaX is provided 'as is'. We do not guarantee that the service is free of errors or interruptions. Our liability is limited to the amount paid for the service in the 12 months prior to the event giving rise to the claim.

9. Duration and termination

9.1 Duration

This agreement has no fixed duration. The Customer may use the services continuously while maintaining an active account and complying with these terms.

9.2 Termination by customer

The Customer may cancel their account at any time without additional cost or penalty, through the platform or by contacting our support.

9.3 Termination by RaX

RaX reserves the right to suspend or terminate access if the Customer breaches these terms, does not make corresponding payments, or for security reasons.

9.4 Effects of termination

After termination, the Customer will lose access to the platform. Data will be retained according to our privacy policy. Any outstanding payment obligations will remain in effect.

10. Service modifications

We reserve the right to modify, suspend or discontinue any aspect of the service with 30 days' prior notice. Substantial modifications to these terms will be notified with the same advance notice.

11. Warranties and limitations

11.1 Customer warranties

The Customer declares and warrants that: (i) has authority to enter into this agreement; (ii) the information provided is truthful and up-to-date; (iii) will comply with all applicable laws in their use of the platform.

11.2 Limitation of warranties

RaX provides the service 'as is'. We do not guarantee that the service is free of errors or interruptions. Our liability is limited to the amount paid for the service in the 12 months prior.

12. Confidentiality

Both parties agree to maintain the confidentiality of sensitive information shared during service provision. This obligation will remain in effect after termination of the agreement.

14. Applicable law and jurisdiction

These terms are governed by the laws of Wyoming, United States. Any dispute will be resolved by the competent courts of Wyoming, USA, without prejudice to mandatory rules regarding competent jurisdiction for consumers in the European Union.
